PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 14 December 1987, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 9, Paragraph 14-12c, AR 635-200, by reason of misconduct, commission of a serious offense—drug abuse, with a general discharge. He was advised of his rights. The applicant consulted with legal counsel, was advised of the impact of the discharge action, and did not submit a statement in his own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general discharge. On 14 January 1988, the separation authority waived further rehabilitative efforts and erroneously directed that the applicant be separated under the provisions of Chapter 9, AR 635-200, as a rehabilitation failure with a general discharge.

         b. On 4 February 1988, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, 11 months, and 9 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 9 contains the authority and outlines the procedures for discharging individuals because of alcohol or other drug abuse. A member who has been referred to the Alcohol and Drug Abuse Prevention and Control Program (ADAPCP) for alcohol/drug abuse may be separated because of inability or refusal to participate in, cooperate in, or successfully complete such a program if there is a lack of potential for continued Army service and rehabilitation efforts are no longer practical. Army policy states that an honorable or general discharge is authorized depending on the applicant’s overall record of service. (However, an honorable discharge is required if restricted use information is used in the discharge process).

2. Finding(s), conclusion(s), and reason(s) for the Board's decision(s) on issues of propriety and/or equity:

         a. Propriety:    The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(2) The issue is accepted. The Board carefully examined the applicant’s record of service during the period of enlistment under review. There was a full consideration of all faithful and honorable service as well as infractions of discipline, the extent thereof, and the seriousness of the offenses. The Board noted that the separation authority approved the applicant’s separation under the provisions of Chapter 9, AR 635-200, by reason of rehabilitation failure with a general discharge. The evidence of record does not support that the applicant was a rehabilitation failure under the provisions of AR 600-85 (The Alcohol and Drug Abuse Prevention and Control Program) at the time of separation. The Board concluded that the discharge was improper. Accordingly, the Board voted to grant relief in the form of an upgrade of characterization of service to fully honorable and a change in narrative reason for separation to Secretarial Authority.

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
